Controller: The entity that determines the purposes and means of processing personal data. Filmcope (Ole Nepomuk Mai) is the controller of your personal data.

Processor: An entity that processes personal data on behalf of the controller.

Services: Our website, client dashboard, and related product-video services collectively.

GDPR: General Data Protection Regulation (EU) 2016/679.

User / You: The individual accessing or using our Services.

§3 Data We Collect

We collect and process the following categories of personal data:

Account Information: Name, email address, company name, password (encrypted), and account preferences.

Order & Asset Content: The product photos, footage, logos, briefs, notes, and reference links you upload or submit for a video.

Usage Data: Pages visited, features used, orders placed, timestamps, and interaction patterns.

Device Information: Browser type, operating system, IP address, and similar technical identifiers.

Payment Information: Billing details, handled by our Merchant of Record (we do not store full card data).

Communications: The content of messages, support requests, and feedback you send us.

§4 Legal Basis for Processing

We process your personal data under the following legal bases of GDPR Article 6:

  • Performance of a contract (Art. 6(1)(b)) — to operate your account, fulfil orders, and deliver videos
  • Legitimate interest (Art. 6(1)(f)) — to secure, maintain, and improve the Services and prevent fraud
  • Legal obligation (Art. 6(1)(c)) — to meet tax, accounting, and other statutory requirements
  • Consent (Art. 6(1)(a)) — where you have given it, such as for optional marketing emails

§5 Your Uploaded Assets

When you upload images, footage, or other content to create a video:

Processing: Your assets are processed and edited solely to produce the Deliverable you ordered.

Storage: Assets are stored securely with our infrastructure providers for as long as needed to provide the Services.

Your Control: You can delete uploaded assets through your dashboard or by contacting us, subject to any legal retention requirements.

§6 Data Retention

We retain your personal data only for as long as necessary for the purposes for which it was collected:

Account Data: For the duration of your account, then deleted within a reasonable period after closure.

Order & Asset Content: Until you delete it or close your account, unless a longer period is required by law.

Payment & Invoice Records: Retained as required by German tax and commercial law (generally up to 10 years).

Communications: Retained for as long as needed to handle your request and for a reasonable period thereafter.

You can request deletion of your data at any time. We will action your request within one month, subject to legal retention obligations.

§7 Service Providers (Processors)

We use trusted third-party providers to operate the Services. They process personal data only on our behalf, under contract, and in line with applicable data protection law. The providers we currently rely on are:

  • Request erasure of your data (Art. 17)
  • Request restriction of processing (Art. 18)
  • Receive your data in a portable format (Art. 20)
  • Object to certain processing (Art. 21)
  • Withdraw consent at any time where processing is based on consent

§9 Cookies

We use only essential technical cookies necessary for the Services to function, such as authentication and security. We do not use advertising or non-essential tracking cookies without your consent. You can control cookies through your browser settings.

§10 Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, or misuse, including:

  • Encryption of data in transit using TLS/SSL
  • Access controls and authentication mechanisms
  • Regular review of our security practices
  • Contracts requiring our processors to safeguard your data

However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

§11 Children's Privacy

Our Services are not directed to children under 16, and we do not knowingly collect their personal data. If you believe a child has provided us with personal data, please contact us at hello@filmcope.com and we will delete it.

§12 International Data Transfers

Your data is primarily processed within the European Union. Where a provider processes data outside the European Economic Area, we ensure appropriate safeguards are in place, such as the European Commission's Standard Contractual Clauses or an adequacy decision.

§13 Changes to This Policy

We may update this privacy policy from time to time. We will post the updated version here and update the "Last updated" date. For material changes, we will provide additional notice where appropriate. Your continued use of the Services after changes take effect constitutes acceptance.

§14 Supervisory Authority

If you are in the European Economic Area, you have the right to lodge a complaint with your local data protection supervisory authority.
