§1 Acceptance of Terms

By accessing or using Filmcope's services, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not use our services.

These terms constitute a legally binding agreement between you and Filmcope. Your use of the services signifies your acceptance of these terms and our Privacy Policy.

We reserve the right to modify these terms at any time. Continued use of the services after changes constitutes acceptance of the modified terms.

§2 Definitions

Filmcope / We / Us / Our: Filmcope (Ole Nepomuk Mai, Goethestrasse 70, 10625 Berlin, Federal Republic of Germany), including our affiliates, officers, directors, employees, and agents.

Services: The Filmcope platform, including our website, client dashboard, and all related product-video creation, editing, and delivery services.

User / You / Client: Any individual or entity that accesses or uses our Services.

Customer Content: Any data, text, images, footage, logos, or other materials you upload, submit, or share with us for use in a project.

Deliverable: The finished product video and any associated materials we deliver to you.

Account: Your registered user account that provides access to our Services.

Order: A single request for a video, as configured and submitted through your dashboard.

§3 Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding contracts
  • You are not prohibited from using the Services under applicable law
  • All information you provide is accurate and current

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

§4 Account Registration

To place an order, you must create an account. You agree to provide accurate, current, and complete information during registration, to maintain the confidentiality of your account credentials, to take responsibility for all activity under your account, and to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these terms or provide false information.

§5 Description of Services

Filmcope creates product videos from the assets and briefs you provide. Depending on your order, this may include editing, motion graphics, sound, voiceover, colour grading, and formatting for different platforms.

Delivery: We aim to deliver finished videos by the next business day after a completed order, but delivery times are estimates and not guaranteed. Timelines may be affected by order volume, the quality and completeness of the assets you provide, and the scope of your request.

Service Availability: We strive for high availability but do not guarantee uninterrupted access. The Services may be temporarily unavailable for maintenance or updates. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

§6 Acceptable Use

You agree not to use our Services for any unlawful or prohibited purpose, including:

  • Violating any applicable laws or regulations
  • Infringing on intellectual property, privacy, or publicity rights
  • Requesting content that is defamatory, obscene, hateful, misleading, or otherwise objectionable
  • Transmitting malware, viruses, or harmful code
  • Attempting to gain unauthorized access to our systems
  • Impersonating others or providing false information
  • Reselling or redistributing the Services without authorization

Violation of this policy may result in immediate account suspension or termination, without refund where permitted by law.

§7 Customer Content and Rights

You retain ownership of the Customer Content you provide. By submitting Customer Content, you grant us a limited, non-exclusive license to use, reproduce, modify, and process it solely to create and deliver your Deliverable.

You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to the Customer Content, including any trademarks, products, people, music, or third-party material it contains, and that our use of it as described will not infringe the rights of any third party.

You are solely responsible for your Customer Content. We may refuse or remove any content that violates these terms or applicable law.

§8 Ownership of Deliverables

Upon full payment for an Order, you receive ownership of, or a worldwide, perpetual license to use, the final Deliverable for your commercial and marketing purposes, including websites, ads, and social media.

Project files, unused footage, source assets, templates, and proprietary editing styles or workflows remain the property of Filmcope unless otherwise agreed in writing. We may showcase non-confidential Deliverables in our portfolio and marketing unless you request otherwise in writing.

§9 Intellectual Property

All intellectual property rights in the Services themselves — including our website, software, designs, text, graphics, and logos — belong to Filmcope or our licensors and are protected by applicable law. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your own business purposes. You may not copy, modify, distribute, sell, or lease any part of the Services without written permission. Any feedback you provide may be used by us without obligation or compensation.

§10 Payment and Billing

Merchant of Record: Payments, invoicing, and tax calculation are processed by our authorized Merchant of Record, Digistore24 GmbH. By completing a purchase, you enter into a transaction with Digistore24 as reseller of Filmcope services, and your invoice will be issued by Digistore24.

Pricing: The price of each Order is shown before you confirm your purchase. Prices are subject to change, but changes do not affect Orders already placed.

Payment Terms: Orders are paid in advance. All fees are non-refundable except as required by law or as explicitly stated in these terms. You must provide current, complete, and accurate payment information.

Failed Payments: If payment fails or is reversed, we may suspend your account and withhold or revoke access to any affected Deliverables until the matter is resolved.

Taxes: Fees do not include applicable sales, use, value-added, or similar taxes. Where applicable, these are calculated at checkout and invoiced by our Merchant of Record.

Refunds: We generally do not provide refunds once work on an Order has begun. We may provide refunds at our discretion, for example in the case of duplicate charges, billing errors, or where required by applicable consumer protection law.

§11 Revisions and Delivery

Each Order includes the number of revision rounds stated at the time of purchase. Revision requests must be reasonable and within the original scope of the Order. Requests that materially change the brief, or that exceed the included revisions, may require a new Order or an additional fee.

You are responsible for reviewing Deliverables promptly and providing clear, consolidated feedback. We are not responsible for delays caused by late, unclear, or incomplete feedback or assets.

§12 Termination and Cancellation

You may stop using the Services and request deletion of your account at any time. We may suspend or terminate your account if you violate these terms or for other legitimate reasons with reasonable notice.

You may cancel an Order before work has begun. Once work has begun, cancellation does not entitle you to a refund except as required by law. On termination, your right to access the Services ceases, you remain liable for any amounts owed, and provisions intended to survive termination will remain in effect.

§13 Warranties and Disclaimers

THE SERVICES AND DELIVERABLES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee any particular business, sales, engagement, or marketing outcome from the use of any Deliverable. Any performance figures, statistics, or examples shown on our website are illustrative and not a promise of results. You use the Deliverables at your own risk.

§14 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILMCOPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.

Our total aggregate liability for any claim arising from these terms or the Services, whether in contract, tort, or otherwise, shall not exceed the greater of the amount you paid us for the Order giving rise to the claim or one hundred euros (€100).

These limitations do not apply to liability that cannot be excluded or limited by law, including death or personal injury caused by our negligence, fraud, or wilful misconduct. If you are a consumer, nothing in these terms affects your mandatory statutory rights.

§15 Indemnification

You agree to indemnify, defend, and hold harmless Filmcope and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to your use or misuse of the Services, your Customer Content, your breach of these terms, or your violation of any law or third-party rights. This obligation survives termination of these terms.

§16 Dispute Resolution

Informal Resolution: Before filing any formal claim, you agree to first contact us at hello@filmcope.com to attempt to resolve the dispute informally. We will try to resolve the matter within 60 days.

Governing Law and Jurisdiction: These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the exclusive place of jurisdiction for all disputes is Berlin, Germany. Mandatory consumer protections in your country of residence remain unaffected.

§17 Data Security and Privacy

We take the security of your data seriously and implement reasonable technical and organizational measures to protect it, including encryption in transit and access controls. You are responsible for keeping your account credentials secure.

We process personal data in accordance with our Privacy Policy. Your data and assets may be stored and processed within the EU and, where appropriate safeguards are in place, with trusted third-party service providers who act on our behalf.

§18 Modifications to Services and Terms

We may modify, update, or discontinue the Services and these terms at any time. When we make material changes to these terms, we will update the "Last updated" date and, where appropriate, notify you by email or via the Services. Changes take effect upon posting (or as otherwise stated). Your continued use of the Services after changes take effect constitutes acceptance.

§19 General Provisions

Entire Agreement: These terms, together with our Privacy Policy and any order-specific terms, constitute the entire agreement between you and Filmcope regarding the Services.

Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of it.

Assignment: You may not assign these terms without our prior written consent. We may assign them to an affiliate, successor, or acquirer.

Force Majeure: We are not liable for delays or failures in performance due to circumstances beyond our reasonable control.
